Overview

Martin (Marty) Redish is a leading constitutional law and First Amendment scholar who delivers sophisticated legal strategy to corporate clients. As a senior counsel in Crowell’s Litigation, Advertising and Media, and State Attorneys General practices, Marty advises major companies across various industries, including pharmaceuticals, insurance, and food and beverage on their most significant and complex issues.

Through decades of pioneering scholarship, Marty has shaped areas of the law such as federal jurisdiction, civil procedure, class action certification, and freedom of expression. His seminal 1971 article, “The First Amendment in the Marketplace: Commercial Speech and the Values of Free Expression,” laid the groundwork for commercial actors and advertisements to receive free speech protections.

Marty is consistently ranked as one of the top-cited legal scholars of all time. In addition to being cited in 22 Supreme court opinions, Marty has appeared as an expert witness before Congress on numerous occasions. He is the author of 18 books, from legal textbooks to applications of political theory, and is the author or co-author of more than 100 academic articles. Marty’s most recent book, Due Process as American Democracy, is set to be released in February 2024. He is also regularly tapped for commentary by prominent news organizations, including the New York Times, TODAY, ABC, and NBC national news, CNN, and National Public Radio.

Outside of Crowell, Marty is the Louis and Harriet Ancel Professor of Law and Public Policy at Northwestern University School of Law, where he has taught since 1973, along with visiting professorships at Stanford University Law School, Cornell University Law School, and University of Michigan Law School. Before his academic career, Marty served as law clerk to the Honorable J. Joseph Smith of the U.S. Court of Appeals for the Second Circuit.

Representative Matters

Over the course of his career, Marty has represented large organizations on important constitutional and jurisdictional issues, including:

  • Served as a consultant and lobbyist for a multinational food manufacturer in its successful effort to stop a combined FTC and FDA attempt to impose severe restrictions on cereal advertising. As part of that effort, he met with numerous congressional staff members and authored a white paper on First Amendment protection for commercial speech which received substantial attention.
  • Served, for three years, as the constitutional trouble shooter throughout the nation for Keene Corporation, an asbestos defendant, arguing numerous free speech and jurisdictional matters.
  • Worked as a consultant for an agrochemical corporation on a major class action.
  • Called as an expert witness before numerous congressional committees on commercial speech and class action issues, served as the tobacco industry’s expert witness on legal-ethical issues in numerous state attorney general suits, and served as an expert witness on class action issues for a U.S. insurance company.
