She has an extensive background in commercial litigation, compliance, and regulatory matters, and has advised clients ranging from individuals to Fortune 100 companies. Amber has experience in federal and state courts in matters involving class actions, contracts, false advertising and unfair competition, trade secrets, torts, healthcare recovery, and complex commercial litigation. Representative Matters
- Nationwide Class Action. Achieved dismissal of nationwide class action suit on motion to dismiss in federal district court on behalf of large national manufacturer of sealant, paint, and home improvement products. The order granting dismissal characterized plaintiffs’ claims as "woefully devoid" of factual allegations.
- Health Care. Represented a large pharmaceutical company in a civil enforcement action by the Department of Justice asserting claims under the False Claims Act and Anti-Kickback Statute.
- Breach of Contract. Represented plaintiff healthcare provider in breach of contract and antitrust litigation. Successfully drafted an opposition to defendants’ motion to compel arbitration that overcame a broad arbitration clause and resulted in denial of the insurer’s motion.
- Employment/Breach of Contract. Successfully defended employer from alleged breach of employment agreement with more than $3 million in damages at issue. Successfully defeated all claims and achieved award of more than $2.2 million on employer’s counterclaims.
- Regulatory Business Disputes. Represented animal product manufacturer in investigation of regulatory defects in business acquired by client and litigation for breaches of acquisition agreement. Successfully brought federal court litigation alleging more than $7 million in damages, resulting in highly favorable settlement for client.
- Trademark. Overcame denial of federal trademark applications for family of five marks owned by comic book publisher. Drafted requests for reconsideration that resulted in all five marks being published for opposition without restriction. Each mark had been previously denied three times.
- OSHA Investigation. Lead counsel on successful defense of OSHA investigation related to a workplace fatality, prevailing with zero adverse findings or fines.
- In-House Experience. Seconded with global chemical conglomerate’s North American legal department. Drafted and negotiated more than 100 nondisclosure agreements and material transfer agreements.
- Municipal Hearings. Successfully represented nonprofit client at highly contested municipal hearings on real property special use permit. The application passed despite opposition testimony from more than 30 witnesses.
