Overview

Amber Gonzales is an associate in the Litigation Group. She has an extensive background in commercial litigation, compliance, and regulatory matters, and has advised clients ranging from individuals to Fortune 100 companies. Amber has experience in federal and state courts in matters involving class actions, contracts, false advertising and unfair competition, trade secrets, torts, healthcare recovery, and complex commercial litigation. She also has experience representing clients in employment disputes, including enforcing non-solicitation and non-compete agreements.

Amber served as a judicial extern under the Hon. Robert E. Blackburn in the U.S. District Court for the District of Colorado.

As a community leader, Amber is the president of the Colorado Hispanic Bar Association, serving on its board of directors for the last seven years. Recently, the Colorado Hispanic Bar Association recognized her commitment to the community with its Outstanding New Hispanic Lawyer Award, in addition to recognitions from Super Lawyers, Best Lawyers, and Latino Lawyers Magazine. Her community involvement also extends to representing clients on a variety of pro bono matters, including drafting position statements and litigation resulting from the denial of requests under the Freedom of Information Act.

Texas Creates Two New Courts: State Supreme Court Upholds Legislature’s Right to Create Statewide Court of Appeals

The Texas Supreme Court recently released its decision in In re Dallas County, affirming the constitutionality of the newly-created Fifteenth Court of Appeals. The Fifteenth will be a statewide court of appeals with jurisdiction over Texas’s new business court for disputes valued over $10 million and appeals where the State or a State agency or university is a named party....

Representative Matters

  • Nationwide Class Action. Achieved dismissal of nationwide class action suit on motion to dismiss in federal district court on behalf of large national manufacturer of sealant, paint, and home improvement products. The order granting dismissal characterized plaintiffs’ claims as "woefully devoid" of factual allegations. 
  • Health Care. Represented a large pharmaceutical company in a civil enforcement action by the Department of Justice asserting claims under the False Claims Act and Anti-Kickback Statute. 
  • Breach of Contract. Represented plaintiff healthcare provider in breach of contract and antitrust litigation. Successfully drafted an opposition to defendants’ motion to compel arbitration that overcame a broad arbitration clause and resulted in denial of the insurer’s motion. 
  • Employment/Breach of Contract. Successfully defended employer from alleged breach of employment agreement with more than $3 million in damages at issue. Successfully defeated all claims and achieved award of more than $2.2 million on employer’s counterclaims. 
  • Regulatory Business Disputes. Represented animal product manufacturer in investigation of regulatory defects in business acquired by client and litigation for breaches of acquisition agreement. Successfully brought federal court litigation alleging more than $7 million in damages, resulting in highly favorable settlement for client. 
  • Trademark. Overcame denial of federal trademark applications for family of five marks owned by comic book publisher. Drafted requests for reconsideration that resulted in all five marks being published for opposition without restriction. Each mark had been previously denied three times. 
  • OSHA Investigation. Lead counsel on successful defense of OSHA investigation related to a workplace fatality, prevailing with zero adverse findings or fines. 
  • In-House Experience. Seconded with global chemical conglomerate’s North American legal department. Drafted and negotiated more than 100 nondisclosure agreements and material transfer agreements. 
  • Municipal Hearings. Successfully represented nonprofit client at highly contested municipal hearings on real property special use permit. The application passed despite opposition testimony from more than 30 witnesses.
