Overview

Clients across a wide array of industries rely on Matt McBurney to manage, litigate, and resolve complex litigations. He provides creative solutions, innovative strategies, and decisive action in addressing the diverse litigation needs and challenges his clients face.

Matt concentrates his practice primarily on litigating complex antitrust cases, with a focus on multinational cartel litigation. He has extensive experience representing both plaintiffs and defendants in such cases, and has done so at both the trial and appellate levels in federal and state courts throughout the country. Matt has also represented agricultural cooperatives and companies in matters related to antitrust immunities, including the antitrust exemption of the Capper-Volstead Act. In addition, Matt has litigated a number of complex cases outside the antitrust context, including cases involving health care issues, product liability, and commercial disputes.

  • Represented a leading multinational technology company as an antitrust plaintiff in price-fixing litigation brought against manufacturers of optical disk drives in the In re Optical Disk Drive Products Antitrust Litigation.
  • Represented a group of 12 antitrust plaintiffs—Motorola Mobility, AT&T Mobility, Sears, Kmart, Target, RadioShack, ViewSonic, Jaco Electronics, Old Comp (Comp USA claims), The Good Guys, Newegg, and Rockwell Automation—in price-fixing litigation brought against manufacturers of liquid crystal displays in the In re TFT-LCD (Flat Panel) Antitrust Litigation.
  • Represented a number of antitrust plaintiffs in price-fixing litigation brought against manufacturers of cathode ray tubes in the In re Cathode Ray Tubes Antitrust Litigation.
  • Represented a leading multinational technology company as an antitrust plaintiff in two separate price-fixing litigation actions brought against manufacturers of dynamic random access memory in the In re DRAM Antitrust Litigation.
  • Represented a group of 12 antitrust plaintiffs—A.O. Smith, Baldor Electric, Delphi, Emerson Electric, Fasco Industries, Rockwell Automation, Robert Bosch, Siemens Transportation Systems, Valeo, and Visteon—in price-fixing litigation against manufacturers of electrical carbon products in the In re Electrical Carbon Products Antitrust Litigation.
  • Defended the largest marketer of potatoes in the United States in a multidistrict litigation alleging a price-fixing conspiracy in the potato industry in the In re Fresh and Process Potatoes Antitrust Litigation.
  • Defended one of the largest egg producers in the United States in a multidistrict litigation alleging a price-fixing conspiracy in the egg industry in the In re Processed Egg Products Antitrust Litigation.
