Alicia Clausen

Associate

Overview

Alicia represents clients in complex commercial disputes, antitrust litigation and investigations, internal and government investigations, and white collar criminal defense matters, with a focus on antitrust and False Claims Act (FCA) matters. A hallmark of her practice is her experience with integrating legal, technological, and international experience to manage e-discovery for litigation, investigations, and other disputes. Clients with big data challenges turn to Alicia to rapidly identify critical information, provide counseling on the efficient and strategic use of artificial intelligence, and proactively advise on litigation readiness.

Alicia has significant experience advising clients on government investigations. In the financial services industry, she has advised several large financial institutions on compliance investigations launched by the SEC and IRS. She has advised a large health care organization on multiple FCA investigations and defended a small business against a baseless FCA lawsuit. She has also counseled multiple organizations on plaintiff and defense-side antitrust lawsuits and FTC second requests.

In addition to her litigation practice, Alicia maintains an active pro bono practice, representing clients in civil, immigration, and criminal proceedings. Among other matters, she has represented a women’s rights activist from Afghanistan seeking asylum, a woman facing severe criminal charges for offenses she allegedly committed as a teenager, and a woman seeking a protective order against her abusive ex-partner. She has also contributed to multiple amicus briefs, including one that was referenced in a decision removing a county commission from office for his role in the January 6 riot.

Going Back to the Basics - Custodial Interviews & Supervised Collections: Building a Defensible Foundation for eDiscovery

Despite advances in eDiscovery technology, custodial interviews and supervised collections remain essential to a defensible and efficient discovery process. This panel will explore why over-reliance on self-collections and search-term-only strategies can lead to incomplete data, increased costs, and court sanctions. Our experts will walk through best practices for conducting effective custodial interviews, identifying and preserving key data sources, and leveraging collaborative workflows that reduce risk and enhance review accuracy. Attendees will gain practical insights on integrating interviews with real-time collections, using tools like screen sharing, documenting workflows for defensibility, and addressing common client objections. Whether you're in-house, outside counsel, or a service provider, this session will help you elevate your approach to ESI identification, preservation, and collection.
