Brussels and Doha – April 1, 2024: The Legal 500 Europe, Middle East & Africa (EMEA) 2024 edition has recognized 16 practice areas and 11 lawyers in Crowell & Moring’s Brussels and Doha offices. The 11 individual lawyers received 18 total rankings across the 16 different practice areas.

Chicago – February 9, 2023: World Trademark Review has recognized Crowell & Moring as a top trademark firm on both sides of the Atlantic, listing Crowell both in the U.S. national rankings and Belgium national rankings in its 2023 guide. In addition to its U.S. national rankings, Crowell received the highest ranking—gold—in Illinois, and also earned regional recognition in California.

On September 3, 2024, the EU Court of Justice overturned the first-instance judgment of the EU General Court, which had held that the European Commission could review transactions that fall below EU and Member States' merger control thresholds through referrals by national competition authorities under Article 22 of the EU Merger Regulation (Case C-611/22 P, Illumina v Commission).

The EU Institutions are currently adding the finishing touches to the new Packaging & Packaging Waste Regulation (“PPWR”) which is expected to be adopted in Q4 2024 or Q1 2025. While many companies are fully preoccupied with preparing for other EU legislation (e.g. the Deforestation Regulation) – companies will ignore the PPWR at their peril. The PPWR contains a host of ambitious legal targets and requirements – which industry will find it difficult to achieve in practice. And the deadlines to comply – are perhaps even more challenging. Companies will need to start preparing for the EU PPWR now, to avoid serious problems – including supply-chain disruption, penalties and litigation – in the future.

The EU legal and policy framework regarding critical medicines and medicine shortages is rapidly changing.  In the past 12 months alone, there have been numerous developments: from the ‘Non-Paper’; to the Communication on ‘Addressing medicine shortages’; and the launch of the Critical Medicines Alliance.  In the next 12 months, there is likely to be similar developments – including a possible draft proposal for a ‘Critical Medicines Act’.  As the new regulatory framework becomes clearer, pharma companies will need to understand it, and prepare for the impact it will have.

This European Directive has the ambition to strengthen the application of the principle of equal pay for equal work or work of equal value between men and women, for all employees in all sectors. The Directive brings significant new reporting obligations and assessment obligations on employers that the EU Member States will publish. How will you have to calculate the threshold to know if your company as an employer falls under the scope of the Directive? And what happens when there is a gap in the equal pay? What will you have to do as an employer? What kind of enforcement does the Directive foresee? Lastly, did you know that in the US there is an Equal Pay Act that has been in force since 1963? How has that statute been applied in the US and what are the differences and similarities with the European Directive? Our special US guest will teach us some interesting US-insights.
