U.S. Supreme Court Upholds Firearms Prohibitions for Domestic Violence Abusers

Washington – June 20, 2024:  In a rare 8-1 decision, the U.S. Supreme Court decided U.S. v. Rahimi today in favor of restricting access to firearms for domestic violence abusers. The higher court held that: “An individual found by a court to pose a credible threat to the physical safety of another may be temporarily disarmed consistent with the Second Amendment.”

Los Angeles – July 16, 2020: The Department of Homeland Security reversed its directive that would have forced international students to leave the United States if they were enrolled in only online classes due to the COVID-19 pandemic. Crowell & Moring worked with the University of California to file a lawsuit against the federal government and motion for injunctive relief, joining other universities making similar moves.

The Fourth Circuit and an Arizona district court both have grappled with the issue of whether a school’s 501(c)(3) tax-exempt-status is a form of “federal financial assistance” under various federal nondiscrimination provisions.  For a nonpublic school to be subject to statutes such as Title VI or Title XI, the school must be a recipient of federal financial assistance.
