Washington – June 1, 2022: Chambers and Partners has ranked 70 Crowell & Moring lawyers in 84 rankings across 40 categories in the Chambers USA 2022 guide. In addition, 37 practice areas were also ranked in the guide. The regional and national rankings are driven by independent interviews of clients and lawyers.

Significant shifts in U.S. technology policy are taking shape at the start of the new administration. This is especially true in the field of artificial intelligence (AI), where President Trump revoked President Biden’s Executive Order 14110, titled “Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence,” as part of his flurry of Day One executive actions. The administration is now moving quickly to put its own stamp on this area in an effort to strengthen U.S. AI leadership and competitiveness and outpace other nations, particularly the People’s Republic of China.

On Saturday, October 7, 2023, California Governor Gavin Newsom signed into law two landmark bills—SB 253, the Climate Corporate Data Accountability Act; and SB 261, the Climate-Related Financial Risk Act—that will require large public and privately-held entities doing business in California to comply with sweeping disclosure requirements regarding their direct and indirect greenhouse gas emissions and their climate-related financial risks.

On May 16, 2023, the U.S. Senate Committee on the Judiciary, Subcommittee on Privacy, Technology, and the Law held a hearing titled “Oversight of A.I.: Rules for Artificial Intelligence.” This hearing is the first in a series intended to provide a forum for industry leaders to discuss and provide an understanding of the implications of A.I. with an eye toward facilitating the development of appropriate guidelines and regulations.

Whether it is personal, customer, training or other data, one thing is clear: data continues to be an important currency and revenue driver for companies. Rapidly changing technology, coupled with developing regulations, requires companies that use or disclose data to be extremely vigilant to stay current. Today, companies struggle to keep up with seemingly nonstop changes to state-level law. These struggles are exacerbated by quickly developing regulations and regimes overseas— creating challenges for international data transfers and international transactions. To optimize the value of their data into 2025 and beyond, companies should consider addressing these challenges with a new focus and additional precision in their commercial agreements.

In 2023, data moved beyond serving as just an “important currency” in the marketplace and evolved into a truly transformative asset class. With this transformation, data requires increased attention and concern by its owners and controllers. Companies are increasingly building, creating derivative works, collecting data, and even focusing on acquiring data through accretive transactions. As a result, stakeholders must understand and address the nuanced legal matters associated with developed or acquired data, which run the gamut from how to actually acquire particular data rights under applicable laws to managing restrictions related to use of tools, such as data analytics and artificial intelligence.
