Landmark Settlement, with Sweeping Array of Restorative Measures, Unveiled in Historic Federalsburg Voting Rights Case

Adding reconciliation to history-making election reform, a landmark settlement was announced today in a federal lawsuit that challenged 200 years of discrimination against Black voters in the Town of Federalsburg. With a sweeping array of restorative measures, the Town seeks to make amends to Black residents for wrongs of the past. The remarkable agreement – the first of its kind in any Maryland voting rights case – was reached through mediation overseen by U.S. Magistrate Judge Erin Aslan; it includes an official apology for historical racism, a street renaming, and community markers commemorating and celebrating the history and contributions of Black residents, among other measures.

Crowell & Moring and ACLU Challenge Racially Discriminatory Election System, Making History in Federalsburg

History was made in September as residents in the Town of Federalsburg, Md. elected the Town’s first Black council members—Darlene Hammond and Brady James. Ms. Hammond and Ms. James were officially sworn into office earlier this month. Before then, the Town had experienced all-white rule for its 200-year history. This dramatic change was brought about in substantial part by a lawsuit filed by Crowell & Moring and the American Civil Liberties Union of Maryland.

Crowell & Moring and ACLU of Maryland Achieve Victory in Removal of the Last Confederate Statue on Public Grounds in Maryland

Washington – September 16, 2021: The Talbot County Council has adopted a resolution to remove the last Confederate statue remaining on public grounds in Maryland. This is a change of position for the Council and follows a lawsuit filed by Crowell & Moring and the American Civil Liberties Union of Maryland. The resolution, passed on September 14, 2021 with a 3-2 vote, orders the movement of the Talbot Boys statue from the Easton courthouse to a private park in Virginia “as soon as is practicable.”

Los Angeles – July 16, 2020: The Department of Homeland Security reversed its directive that would have forced international students to leave the United States if they were enrolled in only online classes due to the COVID-19 pandemic. Harlem Park Residents Sue Baltimore Police, Former Commissioner, Over Drastic, Multi-Day Lockdown

Washington – November 25, 2019: Determined to win justice and ensure that similar lockdowns never happen again, four residents of Baltimore’s Harlem Park neighborhood today filed a federal court lawsuit against the Baltimore City Police Department and former Police Commissioner Kevin Davis, charging that their state and federal constitutional rights were violated during a six-day, multi-block police lockdown of their neighborhood following the death of Detective Sean Suiter in late 2017.

Crowell & Moring and ACLU Achieve Victory in Free Speech Case Challenging Gag Orders Imposed on Survivors of Police Abuse in Baltimore

Washington – July 12, 2019:The United States Court of Appeals for the Fourth Circuit ruled this week that Baltimore’s practice of prohibiting plaintiffs who settle police misconduct cases from speaking about the events precipitating their cases, on pain of losing half their settlement proceeds, violates the First Amendment. The decision in Overbey v. Mayor of Baltimore holds that these non-disparagement clauses—essentially gag orders—are tantamount to the payment of “hush money” to keep victims quiet, and are unconstitutional and unenforceable. Overbey v. Mayor of Baltimore was brought by Ashley Overbey Underwood, a woman who was denied half of her settlement award after responding to negative online comments about her settlement, as had been reported in a local newspaper. After the City learned she had defended herself by describing her experience of being brutalized by Baltimore police, it withheld half her promised proceeds. Overbey was joined as a co-plaintiff in the case by the Baltimore Brew, a news organization that claimed it was denied its First Amendment right to obtain newsworthy public information from victims of police abuses.

Washington – September 7, 2018: The U.S. Court of Federal Claims ruled earlier this week in favor of Montana Health Co-Op, granting its cross motion for summary judgment and denying the U.S. government’s motion to dismiss in the first Cost-Sharing Reduction (CSR) case under the Affordable Care Act (ACA). CSR is a provision under the ACA which offers a discount to qualifying individuals to lower the cost of deductibles, copayments, and coinsurance through tax credits.

Crowell & Moring Prevails Before U.S. Supreme Court in Long Running Western Mineral Rights Controversy

Washington, DC – April 1, 2004: In a case argued to the U.S. Supreme Court in January of 2004, C&M prevailed on March 31, 2004, on behalf of Petitioners BedRoc Limited, LLC, and Western Elite, Inc., in a long running controversy over whether private landowners owned the sand and gravel located on property originally granted under the Pittman Underground Water Act of 1919. That Act rewarded individuals who successfully developed water resources in the Nevada desert by granting them the ownership of desert land. However, Congress expressly reserved "valuable minerals" for the United States. The question presented to the Supreme Court in BedRoc was whether that reservation of "valuable minerals" included common sand and gravel, which had become commercially valuable in recent years. The Interior Board of Land Appeals, Nevada district court and the Ninth Circuit Court of Appeals had ruled in favor of the federal government. C&M represented BedRoc in petitioning for certiorari, and in the merits briefing and argument before the Court.
