New Product Safety Regulation and Future Development in Product Liability from an AI Perspective

An inescapable part of marketing your (non-food) products consists of managing the risks caused by defective and/or non-compliant products.

To deal with the legal aspect of this risk, economic operators must take measures prior to putting their products on the market as well as once the product has been commercialized. Prior to the commercialization, the context in which the product will be made available has to be mapped in order to determine the regulatory framework applicable to the product. Then, once the product has been placed on the market, the economic operator will have to face any regulatory consequences that may arise in relation to safety and regulatory non-compliance issues caused by defects. Finally, product safety defects which cause damages, may give rise to product liabilities whereby current AI developments may create challenges.

During this webinar, we will set out the broader EU safety regulatory framework for consumer and non-consumer products, with a specific attention to the changes, such as those concerning traceability, mandatory rules for recall notices, right to remedy for consumers, etc. introduced by the new General Product Safety Regulation which will replace General Product Safety Directive as of 13 December 2024. With respect to the developments related to the product liability, we will address the expected future developments of the Product Liability Directive related to AI and the AI Act with a special focus on Medical Devices, as example of products prone to AI advancements.
