Crowell & Moring Partners Evan Wolff and Kristin Madigan will be speaking at this year's RSA Conference, which will be taking place April 24-27th in San Francisco.
Evan Wolff, co-chair of Crowell's Privacy & Cybersecurity group, will be a panelist on the "IR: Optimizing Communications and Action Between Legal and Tech Leaders" session on April 25th at 8:30 a.m. PT, along with Wynter Deagle (Partner, Sheppard Mullin Richter & Hampton LLP), Randy Sabett (Special Counsel, Cooley LLP), and moderated by Jennifer DeTrani (General Counsel, Nisos). This panel is meant for small business and enterprise and will cover an array of incidents ranging from ransomware to insider threats recruited for espionage by a nation state actor. The discussion will outline case studies while omitting sensitive client details, present steps to bring an organization together during a crisis, and provide best practices for the intended executive audience.
Kristin Madigan, a member of Crowell's Privacy & Cybersecurity group, will be a panelist on the "I Shot a Deceptive Arrow into the Air - A Mock Hearing" session on April 24th at 10:50 a.m. PT., along with Stanley Barr (Senior Principal Deception Researcher, MITRE), Hon. Laurel Beeler (U.S. Magistrate Judge, U.S. District Court for the Northern District of California), Hoyt L. Kesterson II (Senior Security & Risk Architect, Avertium), and Lauren Topelsohn (Partner, Mandelbaum Barrett PC).
A company has deployed deceptive techniques to lay out a buffet of enticing but fake documents. An attacker takes a byte of the low-hanging fruit, but a lady of thirteen years is hooked. Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
