Please join us for this IJE/IBJ Open Table on Data Protection & Cybersecurity, where you will get a first-hand update from lawyers at the very forefront in this field. This is a chance not to be missed: Crowell & Moring D.C. partners, Jeff Poston and Evan Wolff, whose extensive knowledge and experience is reflected in their position as co-chairs of our global Privacy and Cybersecurity Practice Group, are over from the United States and will bring us up to speed with latest developments and lead the discussion.
In particular, Evan’s experience as advisor to the senior leadership at the Department of Homeland Security (DHS) and other U.S. government agencies makes him an unusual and rich resource, while Jeff’s litigation experience – and specifically his impressive background in handling class actions following data breaches – gives him invaluable insight in this complex area. Jeff and Evan will share their thoughts on best practices and lessons learned, and help you to prepare for the Data Protection challenges and Cybersecurity issues that threaten your organization.
Evan and Jeff will be joined by Chris Olson, Chief Executive Officer, The Media Trust (www.themediatrust.com). Has the Buss Stopped? Recoupment Today
Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
