The Insurance/Reinsurance Department of Crowell & Moring will be hosting a complimentary program on current trends in international directors and officers insurance. Our panel of speakers will include leading insurers, reinsurers, and claims professionals of D&O risks. They will share their insights on developments in jurisdictions around the world.

  • Shanil Williams, Global Head of Financial Lines, Allianz Global & Corporate Specialty - As the head of a leading global underwriter of Directors & Officers insurance, Mr. Williams is perfectly placed to provide an overview of the key developments in D&O business from jurisdictions across the globe. Mr. Williams will discuss the trends from 2019 and share his insights on the challenges and opportunities in 2020.
  • Peter Wedge, EMEA Contracts Wording Counsel, Swiss Re - Exposure to cyber risks has consistently been a top concern for D&O underwriters in recent years. Mr Wedge will discuss cyber exposure in the context of Directors & Officers insurance.
  • Jay Cassidy, Claims Advocate - As a former co-chair of Marsh’s FINPRO claims advocacy group, Mr. Cassidy has continued to be active in presenting D&O claims to the market. Mr. Cassidy will share his experience of common misconceptions in the scope of coverage and will provide anecdotal examples of emerging claims trends.
  • Jason Hegland and Carin LeVine, Stanford Securities Litigation Analytics - Our presenters will share their annual review of trends in U.S. Securities Class Actions, with particular focus on the exposure of foreign corporations, including post-Cyan state litigation trends. This popular feature of our program will give participants an exclusive and different perspective on Securities Class Action trends in 2019 and will discuss the status of particular event-based securities class actions.
  • Giovanni Fanizza, Partner Re, Latin America - Mr. Fanizza will provide an update on claims development against directors and officers in Latin America and a discussion of how local markets are adapting terms and conditions of cover for Directors & Officers Insurance.
  • Mark Meyer, Partner, Insurance & Reinsurance Group Europe, Crowell & Moring - Mr. Meyer will moderate the seminar.

Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
