FAR Council Withdraws Proposed Mandatory Climate Disclosures for Federal Contractor Rule

Mandatory climate disclosures for US federal contractors are officially off the table—at least, for the foreseeable future.  On January 10, 2025, the Department of Defense, General Services Administration, and National Aeronautics and Space Administration announced that they are withdrawing a proposed rule, “Disclosure of Greenhouse Gas Emissions and Climate-Related Financial Risk,” which would have required thousands of federal contractors to inventory and publicly disclose their Scope 1 and Scope 2 greenhouse gas (GHG) emissions and would also have required  “major” contractors to also establish and validate GHG emission-reduction targets tailored to the goals of the Paris Agreement.  The proposed rule, discussed in further detail here, was introduced in November 2022 and resulted in thousands of public comments from the government contractor community and beyond.

On January 6, 2025, the Department of Health and Human Services’ Office for Civil Rights (“OCR”) published a notice of proposed rulemaking (the “NPRM”) entitled HIPAA Security Rule To Strengthen the Cybersecurity of Electronic Protected Health Information. In light of evolving technologies and cybersecurity threats, the NPRM aims to modernize security regulations implementing the Health Insurance Portability and Accountability Act security standards (the “HIPAA Security Rule”) and strengthen protections for the confidentiality, integrity, and availability of electronic protected health information (“ePHI”). Efficiency v Flexibility – The Patent Prosecution Highway (PPH) Program’s Pros and Cons

The Patent Prosecution Highway (PPH) program is a collaborative initiative between the United States Patent and Trademark Office (USPTO) and several foreign patent offices, created to speed up the examination process. Through the PPH, a patent application initially filed with a participating patent office (Office of Earlier Examination, or OEE) can be expedited in another participating intellectual property office, provided it meets specific requirements. According to the USPTO, PPH leverages fast-track examination procedures already in place among participating patent offices to allow applicants to reach final disposition of a patent application more quickly and efficiently than standard examination processing.

Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
