HHS Suggests It Will Provide Less Notice and Opportunity for Comment on Grant and Contract Rules

On February 28, the Department of Health and Human Services (HHS) announced that it was rescinding the Richardson Waiver, a policy in place since 1971 which said HHS would provide notice of proposed rulemaking in certain cases where it was not otherwise required to do so by law. This announcement signals a policy shift for the agency and suggests that where permitted by law, HHS will generally now issue rules relating to “agency management or personnel or to public property, loans, grants, benefits, or contracts” without providing notice and comment to stakeholders, and may otherwise find good cause to forego notice and comment procedures.

FinCEN Pauses Fines and Penalties for Non-Compliance with Beneficial Ownership Information Reporting Deadlines

We previously reported that the Corporate Transparency Act’s Beneficial Ownership Information Reporting Rule (BOI Rule) was back in effect as of February 18, 2025, with a stay of the final nationwide block to enforcement. At that time, the Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN) extended the BOI Rule’s reporting deadline until March 21, 2025 (in cases where the originally-applicable deadline had expired) for entities required to report, which includes certain entities formed or registered to do business in the United States (Reporting Companies).

The Top FCA Developments of 2024

FY 2024 saw continued growth in False Claims Act enforcement, with a record year for new qui tam and government-initiated actions, and the highest total recovery in three years. Enforcement of pandemic-related fraud and cybersecurity noncompliance increased, and health care, procurement, and small business fraud violations were again priority areas. A groundbreaking opinion from the District Court for the Middle District of Florida may have teed up a potentially landscape-shifting decision about the viability of the qui tam mechanism in the not too distant future. And a landmark administrative law decision at the U.S. Supreme Court may impact many FCA cases to come. Significant decisions regarding retaliation, excessive fines, the first-to-file rule, and the public disclosure bar were also handed down by courts of appeals. "The Tide is High New Guidance on Sea-Level Rise," The Environmental Law Section

On December 5, 2024, the San Francisco Bay Conservation and Development Commission (BCDC) adopted the Regional Shoreline Adaptation Plan (RSAP). The RSAP is a region-wide plan for the San Francisco Bay shoreline that guides the creation of coordinated, locally planned sea level rise adaptation actions that work together to achieve a regional One Bay Vision. This includes BCDC’s guidelines for how local governments must meet the requirements of SB 272, a new State mandate that requires all local governments along the shoreline to prepare a Subregional Shoreline Adaptation Plan by 2034. Jon Welner will be the moderator and will be interviewing the Executive Director of the SF Bay Conservation and Development Commission (SF BCDC), which regulates all development in or near San Francisco Bay.
