      <title>New Rotterdam Rules For Maritime Shipping</title>

      <description>On September 23, 2009, officials from sixteen nations, including major maritime and trading powers the United States, Norway, Greece, and The Netherlands, signed what is officially known as the "United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea," or the "Rotterdam Rules" for short. Three more states had signed by October 1. The treaty was negotiated over seven years and adopted by the United Nations General Assembly in December 2008. Representatives from the U.S. State Department have indicated that the treaty will be submitted to the U.S. Senate for ratification in early 2010. </description>

      <description>In a recent decision in Frontera Resources Azerbaijan Corporation v. State Oil Company of the Azerbaijan Republic, the United States Court of Appeals for the Second Circuit held that a state-owned foreign corporation is not entitled to the Due Process jurisdictional protections under the U.S. Constitution where the corporation is deemed to be an agent of a foreign sovereign. Docket No. 07-1815-cv, -- F.3d --, 2009 WL 3067888 (2d Cir. September 28, 2009). The decision is a significant shift in precedent in the Second Circuit, a jurisdiction which includes federal courts in New York City, a hub for international financial transactions and a venue where many award creditors seek to confirm and enforce arbitration awards.       <description>On May 30, 2009, Ecuadorian President Rafael Correa announced that his country would be withdrawing from the International Centre for Settlement of Investment Disputes ("ICSID"), based at the World Bank in Washington, D.C. The move comes on the heels of Ecuador's approval of a new constitution in September 2008, which forbids the country from submitting to arbitration outside of Latin America. In accordance with that constitutional edict, Ecuador's Congress voted on June 12, 2009 to denounce ICSID's arbitration facility. Ecuador would be only the second country, after Bolivia, to withdraw from ICSID. </description>

      <description>On May 7, 2009, the Venezuelan National Assembly enacted the Organic Law Reserving Goods and Services Related to Primary Oil Activities to the State (the "Oil Services Law"). The new legislation allows the Government to take control over essential areas of the oil industry in Venezuela. The Venezuelan National Assembly has justified the adoption of the Oil Services Law as a measure directed to correct an "improper attribution" of strategic areas of the oil industry to foreign companies by the old Petróleos de Venezuela ("PDVSA"). The contracts affected by the Oil Services Law were part of a massive subcontracting process that took place in the 1990s.       <description>28 USC 1782 is a US statute authorizing federal courts to grant discovery assistance to persons and entities involved in disputes before a tribunal outside the US. In In re Application of Babcock Borsig AG, CA No. 08-mc-10128-DPW, Oct. 30, 2008, a federal district court in Massachusetts held that the ICC is a "tribunal" within the meaning of section 1782, and thus, the court had the statutory authority to order a person or entity within the US to provide documents or testimony for use in a foreign proceeding(here, an ICC proceeding).  </description>
